Client was arrested and charged with Criminal Possession of a Controlled
Substance in the Seventh Degree. The client was seated in the rear seat
of a vehicle with two other individuals when the police approached the
car and searched it, locating cocaine on the floor in the front seat.
The client was being prosecuted under the theory of the "Automobile
Presumption", which deems that all the people in the car possess
the seized narcotic. Mr. Rodeman submitted written Motions to the court
contesting the legality of the search of the vehicle. The matter was scheduled
for a hearing and the case was dismissed prior to trial.
