Convicted of a traffic infraction & not a crime
People v.M.B.
The Client was charged with DWI and stopped for failing to maintain his
lane and failure to signal. The client made incriminating statements regarding
his alcohol consumption and failed a series of field sobriety tests conducted
by the arresting officer. The client was arrested and submitted to the
breath test, .16, twice the legal limit. At trial, Mr. Rodeman was able
to keep the breath test out and the client was only convicted of Driving
While Ability Impaired, which is a traffic infraction and not a crime.
